Notice of Significant Non-Compliance for 2023
Notice is hereby given that pursuant to the federal regulations contained in 40 CFR 403.8.f(2)(vii), Central Contra Costa Sanitary District (Central San) is required to publish the names of all Industrial Users (IUs) of Central San’s public sewer system that were determined to be in Significant Non-Compliance (SNC) with applicable pretreatment standards or other pretreatment requirements during the 2023 calendar year. Federal regulations establish objective criteria for Central San to use to determine if an IU is in SNC.
Discharge Quality Violations – The following IUs were found to have discharged process wastewater in violation of Central San’s Local Discharge Limits in a manner that met the definition of SNC.
Industrial User: Acme Fill Corporation – 950 Waterbird Way, Martinez, CA 94553
Nature of Violation: Limit violations for Radioactivity- Gross Alpha & Gross Beta at concentrations that met the SNC Criteria [Technical Review Criteria]
Follow- up Action Taken: Central San issued Notices of Violation (NOVs) for the violations. The IU stated the landfill has never accepted radioactive materials and does not know of any other sources that could have caused the high results. The IU and Central San temporarily increased monitoring for both parameters since no obvious source has been located. Resampling demonstrated that the IU returned to compliance.
Industrial User: Diablo Valley College – 321 Golf Club Road Pleasant Hill, CA 94523
Nature of Violation: Limit violations for mercury (1) and copper (1) in the discharge from the Life Science Building and for Total Toxic Organics (1) in the discharge from the Physical Science building in concentrations that met the SNC criteria [Technical Review Criteria].
Follow-up Action Taken: Central San issued Notices of Violation (NOVs) for the violations. The IU investigated potential sources of copper and mercury within the Life Science laboratory operations and did not locate any significant sources. The IU flushed the waste lines from the Life Science Building to remove potential legacy sources of copper and mercury. The IU investigated sources of Total Toxic Organics within the Physical Science building and determined the event was likely due to an accidental discharge; they will educate staff and students on proper collection procedures. Resampling demonstrated that the IU returned to compliance in both the Life Science and Physical Science buildings.
Reporting Violations – The following IUs failed to provide required reports within 45-days after the due date, which meets the definition of SNC.
Industrial User: Bay Area Rapid Transit 1045 San Miguel Road Concord, CA 94518
Nature of Violation: Failure to meet reporting requirement by deadline for a Periodic Compliance Report; late report met SNC Criteria.
Follow-up Action Taken: Central San issued a Notice of Violation (NOV) for the violation. Central San is working with the IU to submit a complete Periodic Compliance Report.
